This User Privacy Policy (“Privacy Policy”) governs the collection, use, processing,storage, disclosure and protection of Personal Data by DUTI BOOK PRIVATE LIMITED, a company incorporated under the applicable laws of India, having its registered office at 360P, Sector 28, DLF QE, Gurgaon, Haryana – 122002, India (“DutiBook”, “Company”, “we”, “us” or “our”).

This Privacy Policy applies to all individuals who access or use the DutiBook website, mobile applications, digital platforms, products and services offered by DutiBook (collectively, the “Platform”) as a customer, user, visitor or otherwise (“User”, “you” or “your”).

This Privacy Policy should be read together with DutiBook’s Terms and Conditions and any other policies, notices or terms made available on the Platform.

1. PURPOSE OF THIS PRIVACY POLICY

This Privacy Policy is intended to explain, in a clear and transparent manner:

a. what Personal Data DutiBook collects from or about you;

b. why and how DutiBook collects, uses and processes such Personal Data;

c. the circumstances in which DutiBook may disclose or share Personal Data;

d. how DutiBook protects and retains Personal Data;

e. your rights and choices in relation to your Personal Data; and

f. how you may contact DutiBook regarding privacy-related matters or grievances.

DutiBook seeks to process Personal Data in accordance with applicable data protection and privacy laws, including the Digital Personal Data Protection Act, 2023, the rules and regulations made thereunder, and other applicable laws in force from time to time.

2. PERSONAL DATA WE COLLECT

Depending upon your use of the Platform, DutiBook may collect the following categories of Personal Data.

2.1 Account and Profile Information

When you create an account or profile, DutiBook may collect:

  • full name;

  • mobile/telephone number;

  • email address;

  • gender;

  • profile photograph, where provided;

  • account username, login credentials or authentication information;

  • date of birth or age, where required and

  • other information voluntarily provided by you.

Certain information may be mandatory where it is reasonably necessary to create and operate your DutiBook account.

2.2 Address and Location Information

To provide location-based services, DutiBook may collect:

  • residential, service address or house/flat number;

  • locality, city, state and postal code;

  • Current or approximate location;

  • GPS/location coordinates, where you permit access  and

  • other location information voluntarily entered by you.

Location information may be used to identify relevant or nearby Providers, facilitate bookings, enable service delivery and provide location-based features.

You may control location permissions through your device settings. Disabling location access may affect certain App features.

2.3 Booking and Service Information

We may collect information relating to your use of DutiBook, including:

  • Services requested or booked;

  • Service requirements and descriptions;

  • Booking date and time;

  • Service location;

  • Quotations/bids;

  • Provider details;

  • Booking and service history;

  • Cancellation and refund information; and

  • Reviews, ratings and feedback.

2.4. Payment and Transaction Information

Where you make payments through the App, we may process information such as transaction details, payment status, billing information, refund information and transaction/reference numbers.

Payments may be processed through third-party payment gateways. DutiBook generally does not store complete card or banking credentials such as CVV or PIN.

2.5. Device and Usage Information

We may automatically collect certain technical information, including:

  • IP address;

  • Device type and model;

  • Operating system;

  • App version;

  • Device identifiers;

  • Network information;

  • App usage and interaction information;

  • Crash and diagnostic information; and

  • Other information necessary for security and operation of the App.

2.6. Communications and Content

DutiBook may collect information that you voluntarily submit through the Platform, including:

  1. Reviews & ratings; (b) comments & feedback; (c) photographs & videos; 

      (d)  documents; (e) service-related descriptions; (f) messages sent through the Platform; 

      (g) customer support communications; and other content submitted by you.

DutiBook may use such information to provide services, resolve disputes, improve the Platform, investigate complaints, maintain safety and security, and for other purposes permitted under this Privacy Policy and Applicable Law.

3. DEVICE/APP PERMISSIONS

Depending on the features you use, the App may request permission to access:

  • Location – for location-based services, Provider matching and service delivery;

  • Camera – for profile photographs, service-related photographs or document uploads;

  • Photos/Files – for uploading photographs or documents;

  • Notifications – for booking updates, reminders, alerts and service communications; and

  • Microphone/other permissions – where required for a particular feature.

  • OTP/SMS Access- For verification (if applicable)

  • Other Permissions -DutiBook may request additional permissions where reasonably necessary for a particular feature.

You can manage these permissions through your device settings. Certain features may not function if the relevant permission is disabled.

4. PURPOSES FOR WHICH WE PROCESS PERSONAL DATA

DutiBook may collect and process your Personal Data for the following purposes:

  • Account Management: To create, verify, secure and manage your account and profile.

  • Service Delivery: To connect you with relevant Providers, facilitate bookings, quotations, scheduling, service delivery and customer support.

  • Location-Based Services: To identify nearby Providers and facilitate location-based services.

  • Payments: To process payments, refunds, invoices and related transactions.

  • Communication: To send OTPs, booking confirmations, service updates, alerts and other necessary communications.

  • Safety & Security: To prevent fraud, misuse, unauthorised access and other security risks and protect Users, Providers and DutiBook.

  • Platform Improvement: To analyse usage and improve the App, its features, performance and user experience.

  • Legal Compliance: To comply with Applicable Law, regulatory requirements and lawful requests and to establish, exercise or defend legal rights and claims.

DutiBook may also process Personal Data for any other purpose disclosed to you at the time of collection or otherwise permitted under Applicable Law.

5. CONSENT AND LAWFUL PROCESSING

DutiBook may process Personal Data based on:

  • your consent;

  • your request to provide or facilitate a service;

  • compliance with legal or regulatory obligations;

  • prevention of fraud, misuse or security threats; or

  • any other lawful basis permitted under Applicable Law.

Where processing is based on consent, you may withdraw your consent through the available mechanism or by contacting us.

Withdrawal of consent will not affect the lawfulness of processing carried out before withdrawal. It may, however, affect our ability to provide certain features or services that require such information.

DutiBook may continue to retain or process information where required or permitted by law or where reasonably necessary for legal, security, fraud-prevention, accounting or dispute-resolution purposes.

6. SHARING AND DISCLOSURE OF PERSONAL DATA

DutiBook may share relevant Personal Data with:

a. Service Providers/Providers

Information necessary to fulfil your service request may be shared with the relevant Provider, including your name, contact details, service requirements and service location, as applicable.

b. Payment Service Providers

Payment and transaction information may be shared with banks, payment gateways and other payment service providers.

c. Technology and Operational Service Providers

We may engage third parties for services such as:

  • cloud hosting and storage;

  • OTP and communication services;

  • analytics;

  • mapping and location services;

  • cybersecurity;

  • customer support;

  • payment processing; and

  • other technical or operational functions.

Such parties may process Personal Data on behalf of DutiBook and are expected to maintain appropriate safeguards.

d. Government and Legal Authorities

DutiBook may disclose Personal Data where required or permitted by Applicable Law, court order, governmental authority, regulatory requirement or lawful request.

e. Business Transactions

Personal Data may be transferred or disclosed in connection with a merger, acquisition, restructuring, sale of business/assets or similar corporate transaction, subject to Applicable Law.

DutiBook does not sell your Personal Data to third parties.

7. INFORMATION SHARED WITH PROVIDERS

To facilitate services, certain information provided by you may be made available to the relevant Provider.

This may include your:

  • Name;

  • Contact information;

  • Service location;

  • Service requirements;

  • Booking details; and

  • Other information reasonably necessary to provide the requested service.

DutiBook will seek to limit such sharing to information reasonably required for the relevant transaction or service.

8. REVIEWS, RATINGS AND USER CONTENT

Reviews, ratings, photographs, comments and other content submitted by you may be displayed to other Users or Providers where required for the functionality of the App.

You should not upload unnecessary, confidential or sensitive Personal Data belonging to yourself or any other person.

By submitting content, you represent that you have the necessary rights and permissions to submit such content and that it does not violate Applicable Law or any third-party rights.

9. COOKIES AND ANALYTICS

The App may use cookies, SDKs, analytics tools and similar technologies to:

  • maintain App functionality;

  • remember preferences;

  • analyse usage;

  • improve performance;

  • understand User behaviour;

  • detect fraud and security risks; and

  • improve services and features.

Third-party analytics or technology providers may process information on DutiBook’s behalf.

10. DATA SECURITY

DutiBook implements reasonable technical and organisational measures designed to protect Personal Data against unauthorised access, misuse, alteration, disclosure, loss or destruction.

However, no electronic system or transmission method can be guaranteed to be completely secure. Accordingly, while DutiBook takes reasonable precautions, it cannot guarantee absolute security of Personal Data.

If DutiBook becomes aware of a Personal Data breach requiring notification under Applicable Law, it will take appropriate steps to investigate, contain and address the breach and provide notifications where legally required.

11. DATA RETENTION

DutiBook retains Personal Data only for as long as reasonably necessary for the purposes for which it was collected or as required or permitted under Applicable Law.

We may retain certain information after account closure where necessary for:

  • legal and regulatory compliance;

  • tax and accounting requirements;

  • fraud prevention;

  • security;

  • dispute resolution;

  • enforcement of agreements; or

  • establishment or defence of legal claims.

Once retention is no longer necessary or legally required, DutiBook may delete, anonymise or securely dispose of the relevant information.

12. YOUR RIGHTS

Subject to Applicable Law, you may have the right to:

  • access information regarding processing of your Personal Data;

  • request correction or updating of inaccurate information;

  • request deletion of Personal Data, where applicable;

  • withdraw consent where processing is based on consent;

  • raise a grievance regarding the processing of your Personal Data; and

  • exercise other rights available under Applicable Law.

You may submit requests through the contact details provided below. DutiBook may require reasonable information to verify your identity before processing certain requests.

13. ACCOUNT DELETION

You may request deletion of your DutiBook account through the App or by contacting us.

Upon a valid deletion request, DutiBook may delete or anonymise Personal Data that is no longer required.

Certain information may continue to be retained where required or permitted by Applicable Law or where reasonably necessary for legal, security, fraud-prevention, accounting or dispute-resolution purposes.

14.MARKETING COMMUNICATIONS

DutiBook may send transactional and service-related communications necessary for your use of the App.

Where required, promotional communications will be sent in accordance with applicable consent requirements.

You may opt out of promotional communications using the available unsubscribe or communication-preference options. You may still receive essential communications relating to your account, bookings, transactions, security or services.

15.THIRD-PARTY SERVICES

The App may contain or use third-party services, websites, payment gateways, mapping services or other integrations.

Such third parties may have their own terms and privacy policies. DutiBook is not responsible for the privacy practices of third parties that operate independently of DutiBook.

16.CHILDREN'S PRIVACY

The App is not intended for use by individuals who are under 18 years of age and are  not legally capable of providing valid consent under Applicable Law.

17.INTERNATIONAL DATA TRANSFERS

DutiBook may use technology or service providers that process or store Personal Data outside India. Where Personal Data is transferred outside India, DutiBook will take such measures as may be required under Applicable Law.

18.YOUR RESPONSIBILITIES

You are responsible for:

  • providing accurate and updated information;

  • maintaining the confidentiality of your account credentials;

  • notifying DutiBook of unauthorised use of your account;

  • ensuring that information submitted by you does not unlawfully disclose another person's Personal Data; and

  • using the App in accordance with Applicable Law and DutiBook’s Terms & Conditions.

DutiBook shall not be responsible for consequences arising from inaccurate, misleading or unlawfully submitted information provided by you.

19. CHANGES TO THIS PRIVACY POLICY

DutiBook may update this Policy from time to time to reflect changes in the App, our business practices, technology or Applicable Law. The updated Policy will be made available on the App with the revised “Last Updated” date.

Where required under Applicable Law, DutiBook may provide additional notice or obtain consent before implementing material changes.

21. GOVERNING LAW

This Privacy Policy shall be governed by the laws of India.

Any dispute relating to this Policy shall be subject to the applicable dispute-resolution and jurisdiction provisions contained in DutiBook’s Terms & Conditions, except where otherwise required under Applicable Law.

22. ACKNOWLEDGEMENT

By continuing to use the Platform, you acknowledge that you have read and understood this Privacy Policy and agree to the processing of your information in accordance with this Privacy Policy and applicable law.
