TERMS OF USE, CANCELLATION & REFUND POLICY

Effective Date: 9 April 2026

This Terms of Use, Cancellation & Refund Policy (“Agreement”) constitutes a legally binding agreement between you (“User”, “you”, or “your”) and DUTI BOOK PRIVATE LIMITED (“Company”, “we”, “us”, or “our”), governing your access to and use of our website, mobile applications, and related services (collectively, the “Platform”).

By accessing or using the Platform, you expressly acknowledge that you have read, understood, and agree to be bound by this Agreement.

2. NATURE OF PLATFORM

2.1 The Platform is a technology-based marketplace that facilitates connections between users seeking services (“Customers”) and independent third-party service providers (“Vendors”).

2.2 The Company:

  • Does not provide services directly

  • Does not employ Vendors

  • Does not guarantee service quality, safety, or legality

2.3 All contractual obligations relating to services are strictly between the Customer and the Vendor.

3. ELIGIBILITY

You represent and warrant that:

  • You are at least 18 years of age

  • You have the legal capacity to enter into a binding contract

  • All information provided by you is accurate and complete

4. USER ACCOUNT

4.1 Registration may require mobile/email verification via OTP.
4.2 You are solely responsible for safeguarding your account credentials.
4.3 Any activity under your account shall be deemed authorized by you.

5. SERVICES

The Platform may offer:

  • Fixed-price service bookings

  • Bidding-based service engagements

  • Scheduling and communication tools

The Company reserves the right to modify or discontinue services without prior notice.

6. PAYMENTS

6.1 Payments are processed via authorized third-party payment gateways.
6.2 Applicable taxes, including GST, shall be charged.
6.3 The Company may charge platform fees or commissions.

Platform Compliance

  • iOS: Apple In-App Purchase policies apply where required

  • Android: Google Play Billing policies apply where applicable

7. CANCELLATION & REFUND POLICY

7.1 Customer-Initiated Cancellation

Cancellation charges shall apply as follows:

7.2 OTP-BASED SERVICE CONFIRMATION (CRITICAL CLAUSE)

7.2.1 The Platform utilizes a One-Time Password (OTP) verification mechanism to confirm commencement of services.

7.2.2 Upon sharing the OTP with the Vendor, the User expressly acknowledges and agrees that:

  • The service has been initiated, and

  • The Vendor has been authorized to commence work

7.2.3 NO REFUND CONDITION

To the fullest extent permitted by applicable law:

Once the OTP has been shared with the Vendor, the transaction shall be deemed irrevocably confirmed, and the User shall not be entitled to any refund, cancellation, or chargeback under any circumstances, including but not limited to dissatisfaction, partial completion, or early termination of services.

This clause constitutes a material condition of service usage.

7.3 Vendor-Initiated Cancellation

In the event of Vendor cancellation:

  • The User shall be entitled to a full refund

  • The Company may assist in arranging an alternative Vendor

7.4 NO-SHOW

If the User fails to be available at the scheduled service time and location:

  • The booking shall be treated as a no-show

  • No refund shall be issued

7.5 ELIGIBLE REFUND SCENARIOS

Refunds shall be considered only in the following circumstances:

  • Vendor cancellation

  • Service not initiated (OTP not shared)

  • Duplicate or failed transactions

  • Verified technical errors attributable to the Platform

7.6 NON-REFUNDABLE SCENARIOS

Refunds shall not be granted in the following cases:

  • OTP has been shared

  • Late cancellation

  • No-show by User

  • Services already initiated

7.7 REFUND PROCESSING

  • Refunds shall be processed within 5–10 business days

  • Refunds shall be credited to the original payment method

  • Timelines may vary based on payment providers

8. USER-GENERATED CONTENT

Users may submit reviews, ratings, and other content. You agree not to post unlawful, defamatory, or misleading content. The Company reserves the right to remove such content at its discretion.

9. VENDOR LIABILITY

Vendors are independent entities and solely responsible for:

  • Service delivery

  • Quality and safety

  • Legal compliance

The Company shall not be liable for Vendor actions or omissions.

10. PROHIBITED CONDUCT

Users shall not:

  • Violate applicable laws

  • Circumvent platform payment systems

  • Engage in fraudulent or abusive practices

  • Attempt unauthorized access to the Platform

11. INTELLECTUAL PROPERTY

All Platform content, including trademarks, software, and design, is the exclusive property of the Company and protected under applicable laws.

12. PRIVACY & DATA USAGE

User data is processed in accordance with our Privacy Policy.
We collect only necessary data and do not sell personal information.

13. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

The Company shall not be liable for:

  • Indirect, incidental, or consequential damages

  • Service-related disputes between Users and Vendors

  • Loss of data, revenue, or reputation

14. INDEMNITY

You agree to indemnify and hold harmless the Company from any claims, damages, or liabilities arising from:

  • Your use of the Platform

  • Breach of this Agreement

15. TERMINATION

The Company reserves the right to suspend or terminate your account without prior notice in case of violations.

16. THIRD-PARTY SERVICES

The Platform may integrate third-party services (e.g., payment gateways, maps). The Company shall not be responsible for such services.

17. GOVERNING LAW & JURISDICTION

This Agreement shall be governed by the laws of India.
Courts in Gurugram, Haryana shall have exclusive jurisdiction.

18. AMENDMENTS

The Company reserves the right to modify this Agreement at any time. Continued use of the Platform constitutes acceptance of updated terms.

20. USER CONSENT

By using the Platform, you acknowledge that you have read, understood, and agreed to this Agreement, including the binding OTP-based no-refund condition.
