By accessing or using the Dutibook website or mobile application (“Platform”), you agree to comply with and be bound by these Terms & Conditions, along with our Privacy Policy. These terms govern the relationship between Dutibook (Pty) Ltd (“Dutibook”, “we”, “us”, or “our”) and users of our Platform.

Dutibook (Pty) Ltd is a South African registered company. We operate a technology platform that enables users to book verified in-house and independent service professionals (“Service Providers”). Dutibook provides booking technology only and is not directly responsible for the actions or performance of independent third-party professionals.

1. Eligibility

  • The Platform is available only to individuals aged 18 years and above.

  • Users must have the legal capacity to enter binding contracts under South African law.

  • Foreign nationals using the platform must hold a valid work permit or legal status.

  • Dutibook may refuse service to any user at any time at its sole discretion.

2. User Agreement

  • These Terms apply to all visitors, registered users, and businesses using the Platform.

  • Use of the Platform for illegal, fraudulent, or unauthorized purposes is strictly prohibited.

  • Additional terms may apply for specific services and will override these Terms if conflicting.

3. Amendments

Dutibook may update or modify these Terms at any time without prior notice. Continued use of the Platform after such changes signifies your acceptance of the updated Terms. Users are encouraged to review terms regularly.

4. User Information & Registration

  • Users must provide accurate, current, and complete information while registering.

  • A valid mobile number is required for account verification and communication.

  • Dutibook may suspend accounts with misleading or fraudulent details without notice.

  • Users can opt-out of marketing messages at any time.

5. Security & Account Responsibility

  • Users are responsible for protecting account login details.

  • Any unauthorized use must be reported immediately to Dutibook.

  • Dutibook is not responsible for losses due to unauthorized account access.

6. Intellectual Property

  • All content, software, and design elements on the Platform are owned or licensed by Dutibook.

  • Users receive a personal, non-exclusive, non-transferable license to use the Platform.

  • Unauthorized copying, reverse engineering, or redistribution is prohibited.

7. Third-Party Services & Links

The Platform may include links to third-party sites and services. Dutibook is not responsible for:

  • Content or policies of external sites

  • Services provided by Independent Service Providers

  • Claims arising from third-party interactions

Users should review third-party terms before engaging with them.

8. Service Provider & Customer Relationship

  • Dutibook connects users with Service Providers but does not control the service execution.

  • Payments, delivery, service quality, and conduct are the responsibility of the Service Provider and the user.

  • Users should supervise work and safeguard property during service delivery.

9. Charges & Responsibilities

Users agree to pay:

  • Service charges

  • Call-out/visit fee (if applicable)

  • Parts/material cost

  • Convenience or platform fee (if applicable)

  • Any applicable taxes

Users must not:

  • Request illegal tasks

  • Harm or harass Service Providers

  • Misuse the Platform or Service Provider tools/equipment

  • Share confidential data like passwords

10. Indemnity

Users agree to indemnify Dutibook from claims, losses, or liabilities arising from:

  • Misuse of the Platform

  • Violation of these Terms

  • Harm to Service Providers or other Users

  • Illegal activities

11. Liability Limitation

Dutibook is not liable for:

  • Service quality or damages caused by Service Providers

  • Delays, service interruptions, technical failures

  • Loss of data or profits

  • Any indirect, incidental, or consequential damages

Services are provided “as-is” and “as available”.

12. Force Majeure

Dutibook shall not be liable for failures caused by events beyond its control including:

  • Power/internet outages

  • System failures

  • Natural disasters

  • Civil disruptions

13. Termination

Dutibook may suspend or terminate accounts or platform access at any time without notice due to:

  • Policy violations

  • Suspicious or fraudulent activity

  • Legal/regulatory requirements

14. Dispute Resolution

  • Users should contact support for dispute resolution.

  • Disputes may be resolved by mediation or arbitration.

  • South African courts hold exclusive jurisdiction.

15. Tracking & Communication

  • Service Provider location may be tracked for safety.

  • Calls and interactions may be recorded for quality and training.

  • Dutibook may use user contact information for service updates and promotional messages.

Information on the Platform is provided for general use only. Dutibook does not guarantee accuracy, availability, or completeness and will not be liable for any resulting loss.
